1. INTRODUCTION

WTECH INDÚSTRIA E COMÉRCIO LTDA, a private legal entity, registered with the CNPJ under number 13.971.968/0001-07, headquartered in Brazil, hereinafter referred to as “WTECH”, establishes, through this instrument, these Terms of Use, which regulate access to and use of its websites, platforms, applications, social networks, digital tools, institutional portals and other virtual environments (collectively referred to as “Pages”).

These Terms are intended to define the general rules for using the Pages, establish the obligations of users, delimit the rights of WTECH, and set guidelines for security, privacy, governance, and compliance, in strict observance of current Brazilian legislation. Specifically, Law No. 13.709/2018 (LGPD), Law No. 12.965/2014 (Marco Civil da Internet), Decree No. 8.771/2016, the Consumer Protection Code (when applicable), and the guidelines of the ANPD (National Data Protection Authority) apply.

WTECH may, at any time and at its sole discretion, alter , revise , update or supplement these Terms, whether to reflect legal or procedural changes, or to incorporate technological improvements. Updates will be published on: www.wtech-group.com/terms-of-use and, when relevant, may be communicated directly to registered users via email, notices on the Pages, or other appropriate forms of communication.

Continued use of the Pages after updates are posted constitutes automatic and unrestricted acceptance of the new terms and conditions. Therefore, periodic review of this document is recommended to ensure users remain fully informed and in compliance with the current rules.

2. CONDITIONS OF ACCESS AND USE

2.1. Free access and user registration

Access to WTECH's pages is free, unless expressly indicated otherwise. WTECH is not responsible for inconsistencies arising from the provision of incorrect, incomplete, or outdated data. The submission of false, inaccurate, fraudulent, or omitted information may result, at WTECH's sole discretion, in:

• Temporarily suspending access to the Pages;
• Permanent cancellation of registration;
• Inability to use certain services;
• Adoption of administrative, civil and criminal measures, as provided for in applicable legislation.

The user is responsible for all activities performed with their credentials and must maintain confidentiality regarding logins, passwords, and other means of access, under penalty of liability for misuse, damages, or losses incurred by third parties.

2.2. Minors

WTECH's pages and services are not intended for individuals under 18 (eighteen) years of age. If accessed by minors, the use will be considered to be carried out under the exclusive responsibility of the parents or legal guardians, in accordance with article 14 of the LGPD (Brazilian General Data Protection Law).

2.3. Ethical and responsible use

By using the Pages, the user agrees to observe the principles of good faith, ethics, legality, respect, and digital civility, refraining from any act that:

• Violate Brazilian law, morality, good customs, or public order;
• Disseminate hate speech, discrimination, violence, pornography, defamation, insults to honor, or incitement to illegal acts;
• Infringe copyrights, trademarks, patents, trade secrets, or any other intellectual property rights of WTECH or third parties;
• Contains viruses, malicious code, bots, automated scripts, or any element that could impair the functioning of the Pages;

Failure to comply with these rules authorizes WTECH to immediately block, suspend, or terminate the user's access, without prejudice to any applicable legal measures.

3. Intellectual Property and Copyright

All content available on the Pages — including, but not limited to, text, images, graphics, photographs, illustrations, icons, videos, logos, trademarks, trade names, interfaces, audio files, source code, layouts, visual elements, institutional content, technical manuals, promotional materials, and software — is the exclusive property of WTECH or duly licensed third parties, and is protected by national legislation and international treaties on copyright, industrial property, and intellectual property protection.

The user is strictly prohibited from carrying out any form of:

• Reproduction, in whole or in part, of the contents;
• Copying, modifying, editing, adapting, or translating;
• Distribution, marketing, rental, resale or making available to third parties;
• Public display, publication, transmission or retransmission;
• Creating derivative works, reverse engineering, decompiling, or any attempt to improperly obtain the source code;
• Misuse of the trademarks, logos, or distinctive signs of WTECH or its licensors.

Any unauthorized use constitutes a violation of intellectual property, subjecting the infringer to the civil, administrative, and criminal penalties provided for in applicable legislation, including, but not limited to, Laws No. 9.610/1998, No. 9.609/1998, and No. 9.279/1996.

WTECH reserves the right to take all applicable legal measures, including liability for losses and damages, financial reparations, injunctions, and notification to the competent authorities.

4. LINKS, REDIRECTS AND THIRD-PARTY CONTENT

WTECH's pages may contain links, buttons, integrations, plugins, or redirects to third-party websites, platforms, services, applications, or content, provided solely for the user's convenience. The inclusion of these links does not imply, under any circumstances, recommendation, endorsement, validation, guarantee, commercial partnership, sponsorship, or corporate affiliation between WTECH and such third parties.

WTECH is not responsible for information, content, services, privacy policies, terms of use, or any practices carried out on third-party websites; access is at the user's own risk.

Creating links or hyperlinks to WTECH pages will only be permitted if the following requirements are met:

• The link must direct exclusively to the official WTECH homepage, and any redirection to internal pages, restricted areas, or specific content is prohibited, unless expressly and previously authorized.
• The creation of "frames," iframes, mirroring, or total or partial reproduction of the Pages in a way that conceals the origin of the content is prohibited.
• The misuse of trademarks, trade names, logos, slogans, visual elements, or any other distinctive signs of WTECH is prohibited;
• The link cannot be hosted on websites with content that is illegal, offensive, discriminatory, defamatory, pornographic, violent, or harmful to the company's reputation.

WTECH may, at any time, revoke authorizations, request the removal of links, and take legal action if it identifies misuse or violation of its rights.

5. INFORMATION SECURITY AND PRIVACY

WTECH adopts high standards of information security, with best practices in digital governance, access control, segregation of duties, encryption, multi-factor authentication (MFA), continuous monitoring, vulnerability management, and audit logs.

The company fully complies with the LGPD (Brazilian General Data Protection Law), Constitutional Amendment No. 115/2022, the Marco Civil da Internet (Brazilian Internet Bill of Rights), and ANPD Resolutions No. 4/2023 and No. 19/2024.

• Losses resulting from improper use or from information provided by third parties;
• Indirect, special, punitive damages or lost profits;
• False or inaccurate information provided by users.

The user acknowledges that access to the Pages is at their own risk, and agrees to maintain appropriate digital security practices.

7. COMMUNICATIONS AND NOTIFICATIONS

Communication between WTECH and the user may occur through:

• Physical mail;
• Official publications on the Pages;

The user is responsible for keeping their contact information up to date.

Communications sent by WTECH will be considered valid and effective when sent through any of the above means, regardless of read receipt confirmation.

8. FINAL PROVISIONS

The invalidity or ineffectiveness of a clause will not affect the validity of the remainder of the document.

WTECH's tolerance of non-compliance with obligations does not imply waiver or novation.

This current version of these Terms supersedes all previous versions.

Continued use of the Pages implies full acceptance of the updated version.
